We handle the processing of personal data with care and would like to provide clear and transparent information about this. Our privacy statement is in accordance with the legal (European) rules. Below we inform you how we handle your personal data.

Who are we?
ABflexkracht is the data controller – with effect from 25 May 2018 – of the General Data Protection Regulation (hereinafter GDPR). At the bottom of this privacy statement you will find the contact details of ABflexkracht. When we refer to ABflexkracht, we are referring to the legal entity Coöperatie Vereniging ABflexkracht U.A., registered with the Chamber of Commerce under number 34104864, together with its operating companies operating and responsible under Coöperatie Vereniging ABflexkracht U.A. (hereinafter collectively referred to as: ABflexkracht or we or us) for the processing of your personal data as ‘Controller’ within the meaning of the GDPR.

Why does ABflexkracht collect your personal data?
ABflexkracht collects and processes your personal data for a number of purposes. In general, we collect and process your personal data for the performance of our services as a temporary employment, payroll and secondment agency, including mediation, deployment, secondment, payroll, recruitment & selection, personal development, employability, payroll administration and personnel management.

More specifically, we ask you to share your personal data with us for the following purposes, among others:

• To provide you with offers and/or information on services and other activities to better tailor them to your personal needs and/or qualities;

• To communicate with you correctly and clearly;

• To determine your availability and suitability for a particular job or assignment;

• To introduce you to one or more (potential) clients and/or relations of ABflexkracht;

• To approach you for newsletters, events and training opportunities that may be of interest to you, only if you have signed up for them;

• To process the handling of your feedback or complaints;

• To be able to improve our services;

• To establish and maintain an employer-employee relationship by keeping accurate financial, personnel, time, absence and/or payroll records;

• To record an assignment with a client in an agreement with the client and to maintain and fulfil the agreement with the client;

• To provide you with the best possible support or advice in your job search and finding;

• To carry out pre-employment screening for some positions;

• To fulfil our reintegration obligations and comply with the government’s instruction to help people with a distance to the labour market find work;

• To carry out the necessary actions and administration in case we are self-insurer;

• For management purposes including: generating management information and reports, performing market analyses, providing controls and audits, auditing and promoting and maintaining our quality and corporate safety;

• For quality purposes such as certifications;

• To be able to claim subsidies, premium discounts, labour cost benefit etc. and comply with applicable legislation, including identification or payment of taxes and payroll taxes;

• To enable you to access your personal web portal in our private web environment.

When do we collect your personal data?

ABflexkracht collects personal data, for example, when:

• You visit our website;

• You register for a vacancy alert or for a vacancy via our website;

• You register at our office;

• We enter into an employment agreement with each other;

• You contact one of ABflexkracht’s employees by email, telephone or in writing;

• Participating in social media activity or by registering your social media account;

• You otherwise register or are registered to use our services or to provide you with a service.

What personal data do we collect from you?

When you register with us, we collect the following data:

• Name and address, personal email address and other contact details;

• Birth data, age, gender;

• Your work experience, education and training;

• Any references or certificates provided;

• Data on availability and leave;

• Other data that are or may be relevant in the context of assessing the candidate’s suitability, e.g. driving licence or forklift certificate;

• Passport photograph (on a voluntary basis).

> Proof of identity may be stored and checked upon registration to verify whether you are allowed to work in the Netherlands.

If you do not start working for ABflexkracht within four weeks, your ID card will be removed.

From the moment you can start working/have worked for us:

• Nationality;

• Citizen service number/BSN;

• Certificate of Good Conduct (VOG);

• Copy of proof of identity;

• Work permit;

• Other data necessary and relevant for the execution of salary, personnel and absence registration;

• Company data (self-employed persons);

• Login details portal.

At the time of hiring and on-lending you to one of our clients:

• Data necessary within the framework of the disculpation regulation (= hirer’s liability) such as: Name and address details, date of birth, BSN, type of ID card, number and period of validity. If available: residence permit, A1 declaration, work permit.

On what legal grounds may we process your personal data?

ABflexkracht processes your personal data because:

• To properly execute the agreement and/or terms of use we have agreed with you;

• To comply with legal obligations;

• In limited cases pursuant to the consent given by you, where this is possible. The consent given may be withdrawn by you at any time;

• On the basis of a legitimate interest that is consistent with or results from the stated purposes to the extent permitted by law and your privacy.

What special personal data do we process from you?
ABflexkracht processes your special personal data where you have given your express consent to do so, to comply with its legal obligations or where otherwise permitted by or under the law. ‘Special personal data’ refers to data on race, religion or belief, political affiliation, health, sexual life, trade union membership, personal data under criminal law and/or personal data on unlawful or nuisance behaviour. ABflexkracht may process personal data provided by you on your curriculum vitae. This may include information about your origin, trade union membership or your criminal record.

What personal data of business relations do we process?
We also process personal data of business relations. These typically include contact details of employees of clients, suppliers, vendors, referees and other entities with which ABflexkracht has a business relationship. Typically this includes the names, contact details and functions of contact persons, details of the organisation for which you work or represent, for the purpose of making offers on services and other activities, maintaining the business relationship and/or entering into a business agreement.

ABflexkracht processes personal data of business relations because:

With whom may we share your personal data?
Personal data of candidates, temporary employees, self-employed persons
ABflexkracht may disclose your personal data to its clients, subcontractors (data processors) who provide services or carry out assignments on behalf of ABflexkracht, suppliers, government bodies, pension funds and business relations, and in all other cases in which ABflexkracht may be obliged to do so, for example by a court order or court judgment. ABflexkracht may also disclose your personal data to individuals and organisations who have information about, for example, your reference or suitability or to whom we provide data at your request, such as current, former or intended employers, trainers, examination institutes and employment agencies. Or to third parties to whom we provide data – with your explicit consent – or share data at your request in connection with data portability.All The provision of personal data takes place on the basis of a legitimate interest, legal obligation and/or in order to execute the agreement in accordance with the purposes as stated in “Why does ABflexkracht collect your personal data?” Personal data may be transferred outside the Netherlands. ABflexkracht has taken the necessary measures to ensure that all personal data transferred is adequately protected.

Personal data of business relations
ABflexkracht may transfer personal data obtained from its business relations if this is necessary to achieve the objectives of the business relation or for the purpose of mediation. This data may be passed on to applicants, candidates, business partners and subcontractors (data processors) who provide services on behalf of ABflexkracht, and in all other cases in which ABflexkracht may be obliged to do so, for example by a court order or court judgment. Personal data may be transferred outside the Netherlands. ABflexkracht has taken the necessary measures to ensure that all personal data transferred is adequately protected.

How long do we keep your personal data?
We do not retain your data for longer than is necessary for the purpose for which we collected it. The retention periods used by ABflexkracht are in accordance with the legally applicable retention periods.

What cookies do we place?
ABflexkracht’s website(s) use cookies and store technical information. Cookies are small information files that a website leaves on your device with which you visit the website. This includes, for example:

• IP address of the visitor;

• Date and time of a visit;

• URL of the referring site;

• The pages visited on the website;

• Information or the type of browser used.

• Transfer of your data.

In the case of your request, to protect your personal data, we will need to be able to establish your identity. We will respond to your request within 4 weeks.

Securing the processing of personal data
ABflexkracht makes every effort to optimally protect the personal data you have provided. To this end, we have taken physical, administrative, organisational and technical measures to prevent unlawful use, taking into account the latest technology. These measures are periodically evaluated and updated where necessary. If and insofar as data is provided to data processors who provide services or carry out assignments on its behalf, ABflexkracht has agreed with them that they will also optimally secure the personal data. Note that you yourself are responsible for the security of your computer equipment, tablet and/or telephone as well as your own internet connection, and that it is never 100% secure. Sending personal data via the Internet is therefore done at your own risk.

What to do in case of (suspected) data leakage?
If there is a (suspected) data leak, for example, if you suspect loss of or unauthorised access to personal data, please let us know immediately. Please report this to your contact at ABflexkracht or via the contact details listed below.
